Respondent brought this suit claiming that he bought the land from the Kudaki-Akejia family, whom both parties agree are owners of the said land. The purchase was in 1975.
A receipt and complimentary card of P.W.I, the surveyor to the family was given to respondent. He was also shown the land but the land was not allotted to him until 1979 despite having paid in 1975.
Appellant argued that two members (acting under a power of attorney) of the Kudaki-Akejia family sold the land to her in 1974 and put her in possession.
At trial, respondent failed to call any member of the Kudaki-Akejia family while appellant called two.
